  1. General information
    1. The Lessee declares that he or she is at least 23 years old and has had a driving license for at least 1 year.
    2. The Lessee is obliged to present two identity documents (ID card or passport) and a valid driving license.
    3. The Rented Vehicle cannot be used:
      • for the purpose of transporting persons or goods on a sublease or commercial basis,
      • for starting or towing other vehicles, trailers or other objects,
      • in races, rallies or competitions,
      • when the Lessee or another Driver is under the influence of alcohol, hallucinogenic drugs, drugs or other substances that change consciousness and ability to react.
      • The Lessor reserves the right to immediately collect the Vehicle at the Lessee’s expense, in the event of using the Vehicle contrary to the Agreement or in the event of delay in collection, without refund of the deposit.
  2. Duration of the Agreement
    1. The duration of the Rental is strictly specified in the Agreement and extending the Rental by one hour will result in an additional fee being charged.
    2. If the Lessee does not contact and does not return the Vehicle within 12 hours from the date and time of termination of the Agreement, you have the right to consider it as misappropriation and report it to the Police.
    3. Extension of the rental period is possible only with the prior consent of the Lessor, after contacting the Lessor by e-mail or telephone at least 24 hours before the expiry of the lease period provided for in the Agreement and provided that the Lessee pays an advance payment for the additional rental period.
  3. Terms of Use
    1. The Lessee receives a fully fueled Vehicle and is obliged to return the Vehicle with a full fuel tank, refueling at the gas station closest to the Vehicle’s return point. Otherwise, the Lessee shall bear the costs of missing fuel and an additional fee for the refueling service indicated in the additional fees.
    2. The Lessee is obliged to strictly comply with the road traffic regulations in force in a given country. Ignorance of the regulations does not exempt the Tenant from civil and criminal liability.
    3. Smoking and drinking alcohol is prohibited in the Vehicle.
    4. The Lessee receives the Vehicle in good condition, necessary for its operation. The Lessor is obliged to use it with great care and return it in the same condition.
    5. The Lessee receives a clean vehicle. When returning it, you are obliged to return it clean inside and out. If a dirty vehicle is returned, an additional washing or cleaning fee may be charged in accordance with the price list.
  4. The Lessee and/or Driver is obliged to:
    • protect the Vehicle against theft (always lock the Vehicle and activate all anti-theft devices, documents and keys should be carefully protected outside,
    • check the condition of tires, correct tire pressure, operation of lights, inform the Lessor in case of irregularities,
    • use the type of fuel indicated in the engine specifications described in the vehicle registration.
  5. Security
    1. The Lessor reserves the right to share the Renter’s or Driver’s data with authorized bodies (e.g. Police, state authorities).
    2. The Lessee consents to placing a GPS tracking device in the Vehicle.
  6. Trip abroad
    1. In order to travel abroad with the Vehicle, the prior consent of the Lessor is required.
    2. The Lessee/Driver cannot travel by car to the cities of Ceuta and Melilla and to the islands of the Canary Islands or the Balearic Islands.
    3. In the event of a trip abroad, the Lessor is obliged to equip the Vehicle in accordance with the law in force in a given country.
  7. Insurance
    1. The Lessor declares that the Vehicle has third party liability insurance and accident insurance (NNW) valid in countries without travel restrictions indicated in the Agreement.
    2. Only persons using the Vehicle with the prior consent of the Lessor have the right to use the Vehicle.
  8. Failures
    1. In the event of immobilization of the rented Vehicle, the Lessor, if possible, guarantees a replacement Vehicle while performing repair tasks. If the waiting period for the replacement vehicle exceeds 24 hours, the Lessee does not pay any vehicle rental amount for this period.
    2. A replacement vehicle is not provided in the case of:
      • loss of the Vehicle registration certificate and/or insurance policy and/or keys to the Vehicle,
      • breakdown of the Vehicle resulting from the fault of the Lessee or a person not authorized to drive the vehicle,
      • immobilization of the rented Vehicle outside the territory of the country specified in the Agreement
      • acts of vandalism.
  9. Accidents, theft and damage
    1. It is the Lessee’s obligation to report any accident, damage, loss or theft of the Vehicle by e-mail or telephone. Under no circumstances may the Lessee accept claims from third parties.
    2. The Lessee is obliged to provide assistance to the Lessor and/or its insurers in all claims and lawsuits related to the accident or damage, in particular by:
      • submitting a completed and confirmed accident or collision reporting form,
      • providing full details of the people involved in the accident, witnesses of the accident and a detailed description of the event,
      • not leaving the Vehicle unattended and unprotected,
      • if the accident or damage was caused by a third party, taking all necessary steps to identify the person and secure evidence that may help establish liability.
    3. In case of failure to comply with any of the rules described above, the Lessee assumes full financial responsibility for damage caused to the Lessor or a third party.
  10. Lessor’s liability
    1. The Lessor is not responsible for items transported, lost, left in the Vehicle or for expenses (penalties) incurred by the Lessee in connection with the use of the Vehicle during the rental period.
    2. The Lessor is not liable to third parties for claims for compensation resulting from damage caused by the Lessee or another person driving the Vehicle during the Rental Period.
  11. Costs
    1. The Lessee is obliged to cover all expenses related to the rental of the Vehicle.
    2. The payment method is each time agreed with the Lessor.
    3. When renting premium cars to new customers, the rental company may require a refundable deposit.
    4. In the event of shortening the rental period, the funds are not refundable if the shortening was due to the Lessee’s fault.
    5. If a pre-paid reservation is canceled less than 7 days before the rental date, the Lessee will be charged a cancellation fee of EUR 40 and the remaining funds will be refunded within 7 to 14 days.
    6. If a pre-paid reservation is canceled less than 24 hours before vehicle collection, the amount paid will not be refunded.
    7. The Lessee is fully liable for damage to the rented Vehicle in the event of:
      • willful act or gross negligence,
      • damage to the interior of the Vehicle, tires, rims, wipers, antenna, permanent stains, etc.,
      • driving under the influence of alcohol, drugs or other intoxicants, as well as driving without a valid driving license,
      • failure to return the Vehicle registration certificate or keys,
      • fleeing the scene of an accident,
      • entry of the Vehicle abroad without the prior consent of the Lessor and all related costs as well as transport in the event of damage or failure
